LEGISLATION QUESTIONNAIRE

PENAL ENFORCEMENT OF THE CHEMICAL WEAPONS CONVENTION

1. The Executive Council recently drew the attention of States Parties to their obligations concerning national implementation measures under Article VII, paragraphs 1 and 5, of the Chemical Weapons Convention (EC-28/DEC.5, dated 21 March 2002). This followed from the Council’s recognition of the priority role played by “full implementation of the legislative measures required by Article VII” in the OPCW’s contribution to global anti-terrorist efforts (subparagraph 2(b) of EC‑XXVII/DEC.5, dated 7 December 2001). To gain insight into the extent to which the Convention is being implemented in national jurisdictions, a new questionnaire is being addressed to States Parties. In contrast to the first legislation questionnaire which concerned activities under Article VI (S/194/2000, dated 8 June 2000), the scope of the new questionnaire covers enforcement of the Chemical Weapons Convention as a whole.

2. The results of the survey will also be indicative to States Parties of the extent to which Article VII, paragraph 2, can be implemented. If violations of the fundamental provisions of the Chemical Weapons Convention are not legally defined as criminal acts in the jurisdiction of a given State Party, it is unlikely that the State Party in question will be able to cooperate with, and provide legal assistance to, another State Party in investigating or prosecuting that violation.

3. States Parties are requested to return the completed questionnaire annexed to this document to the Secretariat before 31 August 2002. The results of the questionnaire will be reported to the Council at its thirtieth session (10 to 13 September 2002).
