NOTE BY THE DIRECTOR-GENERAL

DRAFT DECISION UNDER ITEM THREE OF THE PROVISIONAL AGENDA OF THE FIRST SPECIAL SESSIONOF THE CONFERENCE OF THE STATES PARTIES

SUBMITTED BY THE UNITED STATES OF AMERICA

The Director-General is hereby circulating letters from the Alternate Permanent Representative of the United States of America to the Organisation for the Prohibition of Chemical Weapons containing a draft decision under agenda item three of the provisional agenda of the Special Session of the Conference of the States Parties (hereinafter the “Conference”).  This draft decision was submitted in accordance with Rule 21 of the Rules of Procedure of the Conference.

Annex 1:        Letters from the Alternate Permanent Representative of the United States of America, dated 19 April (attaching a list of Co-Sponsoring States Parties) and 18 April (referring to a draft decision document for consideration under agenda item 3 of the provisional agenda of the First Special Session of the Conference of the States Parties)

DRAFT DECISION UNDER ITEM THREE OF THE PROVISIONAL AGENDA OF THE SPECIAL SESSION OF THE CONFERENCE OF THE STATES PARTIES CONVENING APRIL 21, 2002

The Conference,

Determined to work for the preservation and effective functioning of the Organization and the Convention, which are put in jeopardy by the lack of confidence in the present Director-General of the Technical Secretariat;

Recalling that, in accordance with Article VIII, Paragraph 19 of the Convention, the Conference of the States Parties shall consider any questions, matters or issues within the scope of the Convention, including those relating to the powers and functions of the Executive Council and the Technical Secretariat, and that it may make recommendations and take decisions on any questions, matters or issues related in the Convention raised by a State Party or brought to its attention by the Executive Council;

Hereby:

Decides to terminate the appointment of the present Director-General José Mauricio Bustani effective immediately, and set in motion the process to appoint a permanent replacement who can enjoy the full confidence of all the States Parties, as soon as practicable.
