DECISION
TERMS OF APPOINTMENT OF THE DIRECTOR-GENERAL
The Conference of the States Parties,
Recalling the decision of the Conference of the States Parties (hereinafter the "Conference") on the terms of appointment of the Director-General (C-II/DEC.4, dated 5 December 1997);
Recalling further the decision of the Executive Council (hereinafter the "Council") on the terms of appointment of the Director-General (EC-VIII/DEC.1, dated 30 January 1998); and
Recalling also that the Director-General was appointed by the Conference at its First Special Session for a term of four years beginning on 25 July 2002, and ending on 24 July 2006 (C-SS-1/DEC.3, dated 25 July 2002);
Hereby:
Decides to establish the following terms of appointment for the Director-General, equivalent to the terms of appointment of other executive heads within the United Nations system who are ungraded officials:
(a)
(i) the Director-General shall receive an annual gross base salary of US$ 213,982 (two hundred and thirteen thousand, nine hundred and eighty-two US dollars) corresponding to an annual net base salary, after application of the staff assessment plan in lieu of national income taxation, of US$ 142,813 (one hundred and forty-two thousand, eight hundred and thirteen US dollars) at the dependency rate, and US$ 127,000 (one hundred and twenty-seven thousand US dollars) at the single rate;
(ii) he or she shall receive a representation allowance equivalent to EUR 25,000 (twenty-five thousand euros) per annum;
(iii) the cost of rent and utilities of a residence appropriate to his or her representational functions shall be borne by the Organisation, up to EUR 102,000 (one hundred and two thousand euros). The Director-General shall contribute to the cost a sum of up to EUR 24,000 (twenty-four thousand euros) per annum. Should these costs be lower, the Director-General's contribution would be reduced proportionally; and
(iv) he or she shall be entitled to post adjustment, allowances and benefits, including social security benefits and separation allowances, for which a staff member in the Professional and higher categories of the Technical Secretariat would be eligible under the Staff Regulations and Staff Rules of the OPCW, provided that the purpose of such emoluments, allowances or benefits has not already been met by other provisions of the present decision;
(b) the Director-General may, at any time, give the Council six months' notice in writing of his or her intention to resign from the service of the OPCW. Upon the expiration of such notice, he or she shall cease to be the Director-General, and his or her contract shall terminate on that date;
Decides further that the terms of appointment of the Director-General as provided for above shall be subject to adjustments by the Executive Council, after consultation with the Director-General, to keep them in line with those of other executive heads within the United Nations system or of members of the staff of the Technical Secretariat, as the case may be.
