DECISION
CHANGES IN CHEMICAL PROCESS EQUIPMENT OR PLANS FOR NEW TYPES OF CHEMICAL PRODUCTS AT A FACILITY CONVERTED FOR PURPOSES NOT PROHIBITED UNDER THIS CONVENTION
The Conference
Recalling the decision of the Executive Council contained in EC-MIV/DEC.2, dated 26 March 1999;
Hereby:
Confirms that if new chemical process equipment is to be installed by a State Party in a converted facility, or if new types of chemical products are planned for production at a converted facility, the State Party shall notify the Technical Secretariat not later than 90 days before the changes are to take place. The Technical Secretariat shall forward this notification, along with its evaluation as to whether the changes in the converted facility have met the requirements under paragraph 71 of Part V of the Verification Annex, to members of the Executive Council for consideration not later than 60 days before the changes are to take place. If an objection is raised by any member of the Executive Council within 30 days of receipt of the notification and evaluation, the Executive Council shall promptly consider the issue and shall forward its recommendation to the Conference of the States Parties for appropriate action, if necessary.
