DECISION
PROGRAMME AND BUDGET
AND WORKING CAPITAL FUND
The Conference
Recalling that Article
VIII, subparagraph 32(a) of the Convention provides that the
Executive Council shall consider and submit to the Conference of the States
Parties the draft programme and budget of the OPCW;
Noting that, in accordance with OPCW Financial Regulation 6.4, a Working Capital Fund shall be established in an amount and for purposes to be determined from time to time by the Conference;
Being aware that Article VIII, paragraph 7 of the Convention provides that financial contributions of States Parties to the Preparatory Commission shall be deducted in an appropriate way from their contributions to the regular budget of the OPCW;
Considering the draft
OPCW programme and budget for 1999 submitted to it
by the Executive Council, as contained in document C-III/DEC/CRP.1/Rev.2, dated
9 November 1998 and Corr.1, dated 20 November 1998;
Hereby:
Adopts the OPCW programme and budget for 1999 annexed hereto and:
(a) appropriates, in Dutch guilders, a total amount of NLG 60,587,400, for the chapter relating to administrative and other costs and NLG 77,160,600 for the chapter relating to verification costs, and authorises the Director-General to incur expenditures for 1999 not exceeding the total amount voted for each chapter;
(b) decides that the appropriations specified in subparagraph 1(a) above shall be financed from contributions by all States Parties in the total amount of NLG 108,040,000 in accordance with the scale of assessments for 1999 approved by the Conference; from estimated interest income in the amount of NLG 1,500,000; and from estimated income from reimbursements from States Parties for certain costs under the provisions of Articles IV and V of the Convention in the amount of NLG 15,000,000; from miscellaneous income provided in kind by the Host Country in the amount of NLG 7,800,000; from payments in kind from States Parties for certain costs under the provisions of Articles IV and V of the Convention in the amount of NLG 5,000,000; and from any additional income from other sources;
(c) requests States Parties to pay their contributions to the OPCW’s 1999 budget in full within thirty days of the receipt of the communication from the Director-General requesting the contribution;
(d) requests States Parties that have not done so to pay immediately their advances to the OPCW Working Capital Fund;
(e) decides to apply as from 1 January 1999 the provisions for the costs of verification under Articles IV and V of the Convention as contained in EC-XI/DEC.1, dated 4 September 1998 as confirmed at the Twelfth Session of the Executive Council (subparagraph 16.5 of EC-XII/3, dated 9 October 1998);
(f) decides with respect to transfers within the budget, pending amendment to the Financial Regulations, that no inter-chapter transfers shall be carried out without the prior approval of the Executive Council; decides that no inter-chapter transfers of personnel resources shall be carried out without informing the Executive Council in advance;
(g) further
decides, pending amendment to the Financial Regulations, that, in
case that the accumulated transfers within a section
(sub-programme) exceed 15% of the original appropriation for that section
(sub-programme), prior approval of the Executive Council shall be required;
(h) requests the Technical Secretariat to consider for the OPCW programme and budget for the year 2000, in consultation with the Advisory Body on Administrative and Financial Matters, further rationalisation of the budget structure, including the issue of financial limits for transfers within programmes or sections (sub-programmes); and
(i) decides that the reclassification of posts contained in document S/64/98, dated 7 August 1998, should be discussed and decided by States Parties at a later stage in the context of future programme and budget negotiations and, consequently, to request the Director-General not to carry out, until then, as a whole or in part, the reclassification of posts.
