The Conference

Recalling that the Commission, in its PC-VI/22, subparagraph 6.8(h), adopted the concept concerning destroyed chemical weapons munitions retained for display or training purposes,

Bearing in mind that the Commission recommended in paragraph 49.2.5 of its Final Report that the Conference adopt the above mentioned concept,

Hereby:

1. Adopts the concept concerning destroyed chemical weapons munitions retained for display or training purposes, annexed hereto.

CONDITIONS UNDER WHICH UNFILLED CHEMICAL MUNITIONS

WHICH A STATE PARTY WISHES TO RETAIN FOR DISPLAY OR TRAINING PURPOSES ARE CONSIDERED DESTROYED

1. As there are no specific provisions within the text of the Convention covering the destruction of unfilled chemical munitions which a State Party may wish to retain for display or training purposes, it follows that the ordinary provisions for destruction shall apply.

2. However, a State Party may wish to destroy unfilled chemical munitions using, on a case by case basis, a destruction process that meets the requirements of the Convention but does not preclude their use for either display or training purposes.

3. In such situations the State Party should inform the Secretariat well in advance of its intentions. One method of doing this would be to use the declaration format for detailed annual plans for destruction.

4. The criteria to be used by inspectors in assessing the destruction of such chemical munitions are, according to Part IV(A), paragraph 12, as follows:

(a) irreversibility of the destruction; and

(b) unusability of the munitions.

5. To be accepted as destroyed the chemical munitions shall meet the above criteria to ensure that they have been rendered harmless and pose no risk to the object and purpose of the Convention.

6. Note should be taken of the destruction processes identified in paragraph 19 of
PC-V/B/WP.17.
