1.         Declarations under this section

            This section applies to declaration and information requirements for Old Chemical Weapons (OCW) produced before 1925 that are stipulated in paragraph 1 (b) (i) of Article III and paragraphs 3, 4 and 6 of Part IV (B) of the Verification Annex of the Convention.  The initial declaration must be made not later than 30 days after entry into force of the Convention for the State Party (EIF(SP)).  Subsequent information must be submitted if additional old chemical weapons are discovered after the initial declaration has been made.

2.2       Outline of declaration/information requirements

(a)        Declaration requirements:

(i)         In accordance with paragraph 5 (a) of Article II, old chemical weapons (OCWs) include  chemical weapons produced before 1925.

(ii)        For such old chemical weapons, a State Party shall submit to the Technical Secretariat, within 30 days of the entry into force of the Convention for it, a declaration pursuant to Article III, paragraph 1 (b) (i).

_Form OCWPRE25 1.0 is to be used for this declaration

(b)        Available relevant information to be provided to the extent possible:

            For the initial declaration as well as for the submission of information related to old chemical weapons discovered after the entry into force of the Convention for it, a State Party is required to submit to the Technical Secretariat, all available relevant information, including, to the extent possible, the location, type, quantity and the present condition of these old chemical weapons.

_Form OCWPRE25 2.0 is to be used for submitting this information.

(c)        Information on the steps being taken for the destruction or disposal:

            A State Party is required to inform the Technical Secretariat of the steps being taken to destroy or otherwise dispose of such old chemical weapons as toxic waste in accordance with its national legislation.  Such information should be provided, preferably, before destruction or disposal.

_Form OCWPRE25 3.0 is to be used for submitting this information.

                                                                                                                                               


3.         Definitions to be referred to in relation to the declaration requirements

            The following definitions taken from the CWC are to be taken into account when making declarations:

"Chemical Weapons" means the following, together or separately:

(a)        Toxic chemicals and their precursors, except where intended for purposes not prohibited under this Convention, as long as the types and quantities are consistent with such purposes;

(b)         Munitions and devices, specifically designed to cause death or other harm through the toxic properties of those toxic chemicals specified in subparagraph (a), which would be released as a result of the employment of such munitions and devices;

(c)        Any equipment specifically designed for use directly in connection with the employment of munitions and devices specified in subparagraph (b).

"Toxic Chemical" means:

Any chemical which through its chemical action on life processes can cause death, temporary incapacitation or permanent harm to humans or animals. This includes all such chemicals, regardless of their origin or of their method of production, and regardless of whether they are produced in facilities, in munitions or elsewhere. (For the purpose of implementing this Convention, toxic chemicals which have been identified for the application of verification measures are listed in Schedules contained in the Annex on Chemicals).

"Tonne" is defined as metric ton, i.e. 1,000 kilograms.

Data formats and technical guidelines for completion of the declaration forms

Instructions in regard to data formats

1.         Names of Countries should be declared using the appropriate code ISO 3166 as contained in Appendix 1.

2.         Dates should be given as CCYY-MM-DD (e.g., 1998-03-31) or for periods as CCYY-MM/CCYY-MM (e.g., 1998-03/1998-09).

3.         Yes-No Questions must always be answered.

4.         Chemicals should be identified by chemical name in accordance with current International Union of Pure and Applied Chemistry (IUPAC) nomenclature, structural formula and Chemical Abstracts Service registry number, if assigned.

5.         The total weight of bulk chemical present at the location shall, if available, be submitted as follows:

(a)        for more than 10 tonnes, rounded to the nearest 1 tonne;

(b)        for less than 10 tonnes and more than 1 tonne, rounded to the nearest 0.1 tonne;

(c)        for less than 1 tonne and more than 0.1 tonnes, rounded to the nearest 0.01 tonne;

(d)        for less than 0.1 tonne, rounded to the nearest 0.001 tonne.

6.         Aggregate quantities of each chemical declared on the aggregate formats are to be declared as accurately as possible and are to be rounded up to the nearest one thousand kilograms.  If such quantity is less than one thousand kilograms, then it is to be rounded up as mentioned in paragraph 5 (c and d) of these instructions.

7.         The measure to be used for declaring the nominal weight of chemical fill for each item is kilograms.

8.         Geographical co-ordinates are to be declared to the nearest second according to the following formats:

            Latitude: 00 (degree)/00(minute)/00(second)/0 (North or South)

            Example: "55/45/28/N"

            Longitude: 000 (degree)/00(minute)/00(second)/0 (East or West)

            Example: "005/32/53/E"

            Co-ordinates should be associated with a specific feature related to the location (e.g., entrance of a site, road intersection).  The geographic reference system used should be specified.

9.         Attachments, if any, are to be identified by unique labels, reference numbers or file names.

10.       If declaration information as a whole is to be treated as confidential, this should be indicated on Form OCWPRE25 1.0, Form OCWPRE25 2.0 and Form OCWPRE25 3.0, with the appropriate classification code (see below).

11.     Those data items prefixed with a " /." may be labelled in accordance with the OPCW classification for confidential information in front of each "/." placed at the beginning of those line items. The following codes are to be used:
