1.         To which declarations will this section apply?

            This section of the declaration handbook will apply for the following:  

(a) Declaration of chemical weapons which are owned or possessed by declaring State Party and/or are located in any place under its jurisdiction or control, in accordance with paragraphs 1(a) (i) and (ii) of Article III of Convention;               

(b) Declaration(reporting) of chemical weapons which are located on its territory that are owned or possessed by another State and located in any place under the jurisdiction or control of another State, in accordance with paragraph 1(a) (iii)of Article III of Convention;

(c) Declaration of chemical weapons which were transferred or received, directly or indirectly, since 1 January 1946 and specification of  the transfer or receipt of such weapons, in accordance with paragraph 1 (a)(iv) of Article III of Convention.

(d) Declaration of all types of simulant filled munitions intended for testing chemical weapons destruction procedures.


2.        Definitions and terms related to the declaration requirements

           The following CWC definitions are important when making declarations:

(a) Chemical Weapons means the following, together or separately:

(i) Toxic chemicals and their precursors, except where intended for purposes not prohibited under this Convention, as long as the types and quantities are consistent with such purposes;

(ii) Munitions and devices, both filled and unfilled, specifically designed to cause death or other harm through the toxic properties of those toxic chemicals specified in subparagraph (a), which would be released as a result of the employment of such munitions and devices;

(iii) Any equipment, both filled and unfilled, specifically designed for use directly in connection with the employment of munitions and devices specified in subparagraph (b).

(b) Toxic Chemical means any chemical which, through its chemical action on life processes can cause death, temporary incapacitation or permanent harm to humans or animals. This includes all such chemicals, regardless of their origin or of their method of production, and regardless of whether they are produced in facilities, in munitions or elsewhere. (For the purpose of implementing this Convention, toxic chemicals which have been identified for the application of verification measures are listed in Schedules contained in the Annex on Chemicals.) 

(c) Precursor means: Any chemical reactant which takes part at any stage in the production by whatever method of a toxic chemical. This includes any key component of a binary or multi-component chemical system. (For the purpose of implementing this Convention, precursors which have been identified for the application of verification measures are listed in Schedules contained in the Annex on Chemicals.)

 (d) Key Component of Binary or Multicomponent Chemical Systems (hereinafter referred to as "key component") means: The precursor which plays the most important role in determining the toxic properties of the final product and which reacts rapidly with other chemicals in a binary or multi-component system.

 (e) Tonne is defined as metric ton, i.e. 1,000 kg.          


3.         Explanations of some of the terms used in relation to declarations

(a) toxicity of chemicals shall be reported in Lct 50 or LD 50 as applicable.

(b) equipment specifically designed for use directly in connection with the employment of munitions, sub munitions, devices or equipment defined as chemical weapons refers to items that are part of a chemical weapons not intended for filling with chemicals.

(c) A bulk container Refers to items with a fill capacity equal to or greater than 2 cubic meters.

(d) OTHER Containers Refers to items with a fill capacity of less than 2 cubic meters.

(e) COMMON MILITARY DESIGNATOR Refers to the letters and/or figures which are usually used by the declaring State Party in field circulars and inventories to refer to  chemicals or munitions, sub munitions, devices, equipment or containers.

(f) NOMINAL WEIGHT OF CHEMICAL FILL It is the design capacity of filled munitions, sub munitions, devices and equipment defined as CW.

(g) TEMPORARY HOLDING AREA at a CW destruction facility is defined as a location within the declared perimeter of a CW destruction facility  holding at any time no more than the amount of agent or materiel for one week of destruction based on the declared design capacity of the destruction facility.


Annex A of Section D
Instruction and technical guidelines for completing the forms.

1. Names of Countries are to be declared using the appropriate  code ISO 3166 as contained in Appendix 1.

2. Dates are to be given as YYYY-MMM-DD (e.g., 2000. OCT 31) [1] .

3. Yes-No Questions must always be answered.

4. Chemicals shall be identified by chemical name in accordance with current International Union of Pure and Applied Chemistry (IUPAC) nomenclature, structural formula and Chemical Abstracts Service (CAS) registry number, if assigned. For a precursor, the toxicity and identify of the principal final reaction product(s) shall be provided.

5. In cases, involving mixtures of two or more chemicals, each chemical shall be identified and the percentage of each shall be provided, and the mixtures shall be declared under the category of the Most Toxic Chemical. One declaration form is to be completed for each declared mixture at the facility.  Mixtures of the same chemicals which have significantly different proportions of the individual chemicals shall be declared individually.

6. TOTAL WEIGHT

(a) Each Item The weight measure used in declaring the nominal weight of chemical fill  for each item is kilograms.

(b) Each Facility The total weight of each chemical present at the facility shall be declared and rounded as:

(i) for quantities more than 10,000 kilograms (10 tones), rounded to the nearest  1000 kilograms (1 tonne);

(ii) for quantities less than 10,000 kilograms (10 tones) and more than 1000kilograms (1 tone), rounded to the nearest 100 kilograms;

(iii) for less than 1000 kilograms (1 tonne) and more than 100 kilograms (0.1 tonne), rounded to the nearest 10 kilograms (0.01 tonne);

(iv) for less than 100 kilograms (0.01 tonne), rounded to the nearest  kilogram (0.001 tonne).

7. Aggregate quantities National aggregate quantities of toxic chemicals and their precursors defined as chemical weapons should be rounded up to the nearest one tonne. .  Quantities of less than 1 tonne are to be rounded in accordance with paragraph 6 (c and d) above.

8. The ACTUAL WEIGHT RATIO for components of binary and/or multi-component chemical weapons is to be rounded to the second decimal place.

9. PERCENTAGE OF EACH CHEMICAL for mixtures of two or more chemicals (including non-toxic chemicals) shall be reported as precisely as possible, preferably to the nearest 1%.

10. Geographical co-ordinates are to be declared to the nearest second (indicate geographic reference system) according to the following formats:

(i)    Latitude: 00 (degree)/00(minute)/00(second)/0(North or South)

Example: "55/45/28/N"

(ii)   Longitude: 000 (degree)/00(minute)/00(second)/0(East or West)

Example: "005/32/53/E"

(iii)   Co-ordinates should be near the geometric centre of the facility, preferably associated with a recognisable geographic feature (e.g., the corner of a building, road intersection)

11. Attachments, if any, are to be identified by unique labels, reference numbers or file names.

12. A Site diagram for each facility is to be attached showing:

(a) A clearly identified declared perimeter. The perimeter will be used during inspections and should indicate, where possible, man-made or natural features  ( e.g., roads, fences, railroad tracks, or rivers);

(b) Roads, fences, railroads, rivers, and any other significant geographical  features in the vicinity of the facility;

(c) The location of all buildings, bunkers, and storage areas within the declared perimeter, with building structure numbers, and an indication of the purpose of each. All buildings, bunkers and storage areas within the declared perimeter that are not related to CW storage should be so annotated. The purpose of each building, bunker and storage area may be included in an attachment to the site diagram;

(d) An arrow indicating true north;

(e) A legend explaining any abbreviations and a map scale;

(f) All entrances/exits including personnel gates to the facility;

(g) Where the geographic co-ordinates (in paragraph 11 above) were taken.

13. FORM CW 1.0: Identification of CW Declaration is used by a State Party to specify which declaration forms  it is submitting to the Technical Secretariat.

14. The CWS forms refer to the declaration of CW which are owned or possessed by a State Party and are located in any place under its jurisdiction or control, in accordance with paragraph 1(a) (ii) of Article III of the Convention.

15. The CWSAS Forms refer to the declaration of CW which are located on the territory of a State Party and are under the jurisdiction or control Another State, in accordance with paragraph 1(a) (iii) of Article III of the Convention.

16. The CWt Forms refer to the declaration of Transferred CW in accordance with paragraph 1(a) (iv) of Article III of the Convention.

17. The CWr Form  refer to the declaration of CW Received in accordance with paragraph 1(a) (iv) of Article III of the Convention.

18. For TRANSFERS and RECEIPTS, separate forms are required for each supplier or recipient State.

19. Past TRANSFERS OR RECEIPTS of CW are to be declared provided the amount transferred or received exceeded 1 ton per chemical per year in bulk and/or munitions form.  For Transfers or Receipts between 1 January 1946 and 1 January 1970, the State Party shall declare whatever information is still available to it and provide an explanation if it cannot submit a full declaration.  Separate forms are required for each calendar year.

20.  CHEMICALS SPECIFICALLY DESIGNED for use directly in connection with the employment of munitions, sub munitions, devices and equipment defined as chemical weapons shall be declared if stored separately from such munitions, sub munitions, devices or equipment, but within the boundaries of the CW storage facility.

21. The projected quantity of the toxic end-product of BINARY CHEMICAL WEAPONS  is to be calculated on a stochiometric basis from the key component, assuming a 100 percent yield.

22. For a CHEMICAL NOT LISTED in the Schedules in the Annex on chemicals, the information required for possible assignment of the chemical to the appropriate Schedule shall be provided, including the toxicity of the pure compound.  Such information will be in an attachment to the declaration form.

23. Storage facility at  a CW destruction facility and temporary holding areas at destruction facilities shall be declared using the form as for  CW STORAGE FACILITY.

24. If declared information as a whole is to be treated as Confidential, this should be indicated on Form CW 1.0 (Primary Declaration), with the appropriate classification code (see below).

25. If, however, only parts of the information are confidential these may be indicated on the individual Declaration  Forms where a slash (i.e. "R/.") is shown, by inserting the appropriate confidential code before the slash. The codes are as follows:
